These Terms & Conditions define the rights and obligations between Luberone and its customers for purchases made on www.luberone.com.

They set out the rules relating to orders, payments, deliveries, cancellations, warranties and the protection of personal data.

Any order placed on this website implies the Customer's full and unconditional acceptance of these Terms & Conditions.

1. DEFINITIONS

The following terms, when used in these Terms & Conditions, shall have the meanings set out below:

"CUSTOMER": means any individual purchasing products from the SELLER for personal use and acting outside the scope of any commercial, business, craft or professional activity.

"DELIVERY": means the first presentation of the PRODUCTS ordered by the CUSTOMER at the delivery address provided during the ordering process.

"PRODUCTS": means all products offered for sale on the WEBSITE.

"TERRITORY": means all countries to which PRODUCTS available on the WEBSITE may be ordered and delivered at the time the order is placed.

2. PURPOSE

These Terms & Conditions govern the sale by the SELLER of the PRODUCTS available on the WEBSITE and purchased by the CUSTOMER.

4. CUSTOMER ACCOUNT AND PURCHASES ON THE WEBSITE

To purchase PRODUCTS on the WEBSITE, the CUSTOMER must be at least 18 years of age and legally capable of entering into binding contracts.

If not already registered, the CUSTOMER may be invited to create a customer account by completing the registration form available on the WEBSITE. Fields marked with an asterisk (*) are mandatory and required for order processing.

5. ORDERS

5.1 PRODUCT INFORMATION

The SELLER makes every effort to present the essential characteristics of the PRODUCTS as clearly and accurately as possible on the WEBSITE.

Customers are encouraged to carefully review all information relating to a PRODUCT before placing an order.

The SELLER reserves the right to modify the range of PRODUCTS available on the WEBSITE at any time, particularly due to supplier constraints.

Product photographs are provided for illustrative purposes only and are not contractually binding.

Unless otherwise specified, all PRODUCTS sold on the WEBSITE are new and comply with applicable European regulations and standards.

5.2 ORDERING PROCESS

Orders are placed directly through the WEBSITE. The CUSTOMER must follow the ordering process described below, although certain steps may vary depending on the device or page used.

5.2.1 Product Selection

The CUSTOMER selects the desired PRODUCT(S), colour, size and quantity. Product descriptions and key characteristics are displayed on the relevant product pages.

Once selected, the PRODUCTS are added to the shopping cart. The CUSTOMER may continue shopping and add additional PRODUCTS before completing the order.

5.2.2 Order Confirmation

Before finalising the order, the CUSTOMER must review the contents of the shopping cart and ensure all information is correct.

If not already logged in, the CUSTOMER will be asked to sign in or create an account.

A summary of the order, including PRODUCT details, applicable taxes, shipping costs and total price, will then be displayed.

The CUSTOMER is responsible for verifying all order information, including quantities, references, billing details, delivery address and payment method.

The CUSTOMER may then proceed to secure payment and provide all information required for billing and delivery.

Orders must contain all information necessary for proper processing.

The CUSTOMER must also select the preferred shipping method offered on the WEBSITE.

5.2.3 Order Acknowledgement

Once the order has been completed, an order confirmation page will be displayed and a confirmation email will automatically be sent to the email address provided by the CUSTOMER.

The SELLER does not send order confirmations by post or fax.

5.2.4 Invoicing

During checkout, the CUSTOMER must provide all information necessary for invoicing and delivery.

Particular attention should be paid to the accuracy of the delivery address and any information required to facilitate delivery.

The CUSTOMER must then choose a payment method and enter the required payment details.

Neither the online order confirmation nor the acknowledgement email constitutes an invoice.

The original invoice will be included with the shipment or otherwise made available to the CUSTOMER.

The SELLER retains an electronic copy of all invoices.

5.3 ORDER DATE

The order date corresponds to the date on which the SELLER electronically confirms receipt of the order.

Any delivery times displayed on the WEBSITE are calculated from this date.

5.4 PRICES

All prices displayed on the WEBSITE are shown in euros and include applicable taxes.

Shipping costs, when applicable, are calculated according to the delivery destination, shipping method and parcel weight.

Prices include VAT at the rate applicable on the date of purchase.

Any change in the applicable tax rate may affect the price of PRODUCTS from the effective date of such change.

The SELLER reserves the right to modify prices at any time, particularly in response to supplier pricing changes or promotional offers.

The applicable price is the one displayed on the WEBSITE at the time the order is confirmed by the CUSTOMER.

5.5 PRODUCT AVAILABILITY

PRODUCT availability depends on stock levels.

The SELLER undertakes to fulfil orders subject to PRODUCT availability.

If a PRODUCT is unavailable, this information is generally indicated on the relevant product page.

Should a PRODUCT become unavailable after an order has been placed, the CUSTOMER will be informed as soon as possible.

At the CUSTOMER's request, the SELLER may:

  • ship the entire order once all PRODUCTS become available;
  • ship available PRODUCTS first and dispatch the remainder later;
  • offer an equivalent replacement product of similar quality and value.

If the CUSTOMER chooses to cancel an order for an unavailable PRODUCT, all amounts paid for that PRODUCT will be refunded as soon as possible and no later than thirty (30) days after payment.

6. RIGHT OF WITHDRAWAL

The terms and conditions governing the Customer's right of withdrawal are set out in the Withdrawal Policy contained in Appendix 1 of these Terms & Conditions and accessible at any time via a link located at the bottom of each page of the Website.

7. PAYMENT

7.1 PAYMENT METHODS

The CUSTOMER may pay for PRODUCTS online using the payment methods available on the WEBSITE.

When selecting a payment method, the CUSTOMER will be redirected to the relevant secure payment platform to complete the transaction.

The CUSTOMER warrants that they are fully authorised to use the chosen payment method.

By providing payment details, the CUSTOMER authorises the payment provider to debit the total amount of the order.

The SELLER takes all reasonable measures to ensure the security and confidentiality of payment data transmitted online.

Payment information is processed directly by the secure payment provider and is never stored or processed by the WEBSITE.

The SELLER does not collect, store or process the CUSTOMER'S banking details.

The SELLER shall not charge fees exceeding the costs incurred for the use of the selected payment method.

7.2 PAYMENT DATE

For payments made by credit or debit card, the CUSTOMER'S account will be charged when the order is placed.

In the event of partial delivery, the total amount may be charged no earlier than the dispatch of the first parcel.

If an order is cancelled due to product unavailability, any refund will be processed in accordance with Article 5.5 of these Terms & Conditions.

7.3 LATE OR REFUSED PAYMENT

If a payment is declined by the CUSTOMER'S bank or payment provider, the CUSTOMER must contact Customer Service and arrange payment using another valid payment method.

If, for any reason, the transfer of funds cannot be completed, the order will be automatically cancelled and the sale terminated.

8. RECORDS AND ARCHIVING

In accordance with applicable French consumer law, any contract relating to an order exceeding €120 including VAT will be archived by the SELLER for a period of ten (10) years.

The CUSTOMER acknowledges that the ordering process and these Terms & Conditions constitute an electronic contract between the CUSTOMER and the SELLER.

The SELLER retains electronic records of transactions in order to ensure proper order tracking and contractual evidence.

The CUSTOMER agrees not to challenge the validity of the contract solely because it has been stored electronically.

In the event of a dispute, the SELLER may rely on electronic records as evidence of the integrity and reliability of the transaction.

9. RETENTION OF TITLE

Ownership of the PRODUCTS remains with the SELLER until full payment has been received.

However, the risk of loss, theft or damage to the PRODUCTS passes to the CUSTOMER, or to any third party designated by the CUSTOMER other than the carrier, upon delivery.

10. DELIVERY

Delivery conditions are detailed in the Delivery Policy contained in Appendix 2 of these Terms & Conditions and accessible at any time through a link available at the bottom of each page of the WEBSITE.

11. PACKAGING

PRODUCTS are packaged in accordance with applicable transport standards in order to ensure maximum protection during shipment.

Customers are required to use appropriate packaging when returning PRODUCTS.

12. WARRANTIES

12.1 COMMERCIAL WARRANTY

The SELLER warrants that PRODUCTS purchased through the WEBSITE will be free from manufacturing and material defects under normal use for a period of one (1) year from the original purchase date.

This warranty applies only to the original purchaser, is non-transferable and is valid solely in the country where the purchase was made.

The warranty covers manufacturing and material defects only and does not apply to damage resulting from normal wear and tear, accidental damage, misuse, negligence, improper storage, impact, exposure to liquids or any other external cause.

To make a warranty claim, the CUSTOMER must first contact the SELLER at: [email protected] and provide the invoice number together with their contact details.

The CUSTOMER will then be instructed to return the defective PRODUCT, in its original packaging where possible, at their own expense for inspection.

If the defect is confirmed and falls within the warranty period, the SELLER may repair or replace the defective PRODUCT or component with an equivalent new or refurbished item.

Any replacement PRODUCT shall remain covered for the remainder of the original warranty period.

Where repair or replacement is not possible, the SELLER will refund the purchase price within thirty (30) days of receiving the returned PRODUCT.

12.2 LEGAL CONFORMITY WARRANTY

The commercial warranty described above does not affect the CUSTOMER'S statutory rights under applicable consumer protection laws.

The SELLER is required to deliver PRODUCTS that conform to the contract and is liable for any lack of conformity existing at the time of delivery.

The SELLER is also responsible for defects resulting from packaging, assembly instructions or installation where these were undertaken under the SELLER'S responsibility.

To be considered compliant, a PRODUCT must:

  • be fit for its usual purpose;
  • match the description provided on the WEBSITE;
  • possess the qualities that a customer may reasonably expect.

Product photographs are provided for illustrative purposes only and are not contractually binding.

Claims relating to lack of conformity may be brought within two (2) years from delivery of the PRODUCT.

In the event of a conformity defect, the CUSTOMER may request repair or replacement of the PRODUCT.

However, if the chosen solution would impose disproportionate costs compared with the alternative remedy, the SELLER reserves the right to provide a refund instead.

Where repair or replacement is impossible, the SELLER will refund the purchase price within thirty (30) days following receipt of the returned PRODUCT.

12.3 WARRANTY AGAINST HIDDEN DEFECTS

The SELLER remains liable for hidden defects that render a PRODUCT unfit for its intended use or significantly reduce its usefulness to the extent that the CUSTOMER would not have purchased it, or would have paid a lower price, had they been aware of the defect.

Where a hidden defect is proven, the CUSTOMER may choose either:

  • a full refund upon return of the PRODUCT; or
  • a partial refund while retaining the PRODUCT.

If repair or replacement is not possible, the SELLER will refund the PRODUCT within thirty (30) days after receiving the returned item.

Any action relating to a hidden defect must be brought within two (2) years of the discovery of the defect.

13. LIABILITY

The SELLER shall be liable only for direct damages suffered by the CUSTOMER as a result of an order or purchase made through the WEBSITE.

The SELLER does not control websites that may be linked directly or indirectly to the WEBSITE and therefore accepts no responsibility for their content, accuracy or availability.

Links to third-party websites are provided for information purposes only and do not imply any endorsement or guarantee by the SELLER.

14. PERSONAL DATA

The SELLER collects and processes personal data relating to its CUSTOMERS, including through the use of cookies.

Customers may manage or disable cookies through their browser settings.

Personal data collected by the SELLER is used to process orders, manage customer accounts, monitor transactions, prevent fraud and, where the CUSTOMER has given consent, send newsletters, promotional offers and marketing communications.

Customer data is treated confidentially and processed in accordance with applicable data protection regulations, including the General Data Protection Regulation (GDPR).

Customers may unsubscribe from marketing communications at any time by accessing their account or by clicking the unsubscribe link included in marketing emails.

Personal data may be shared with service providers involved in payment processing, order fulfilment, shipping or other services necessary to complete the CUSTOMER'S order.

For marketing purposes, the SELLER may share customer information with selected commercial partners only where the CUSTOMER has expressly consented to such disclosure.

Customers may withdraw their consent at any time by contacting the SELLER.

The CUSTOMER has the right to access, rectify, update, restrict, object to or delete personal data concerning them.

16. INTELLECTUAL PROPERTY

All visual, graphic, photographic, textual, audio and technical elements of the WEBSITE, including its underlying technology, are protected by copyright, trademark and intellectual property laws.

These elements remain the exclusive property of the SELLER.

Any reproduction, distribution, modification, adaptation, publication or commercial use, whether in whole or in part, is prohibited without the prior written consent of the SELLER.

Any website wishing to create a direct hyperlink to the WEBSITE must first obtain written authorisation from the SELLER.

Such authorisation may be withdrawn at any time without notice.

The use of framing, inline linking or any technique designed to integrate the WEBSITE into another website is strictly prohibited.

17. VALIDITY OF THE TERMS & CONDITIONS

Should any provision of these Terms & Conditions be declared invalid, unlawful or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain fully valid and enforceable.

The invalidity of one provision shall not affect the validity of the remaining provisions.

Any matter not expressly covered by these Terms & Conditions shall be governed by applicable laws and generally accepted practices relating to consumer e-commerce in France.

18. AMENDMENTS TO THE TERMS & CONDITIONS

These Terms & Conditions apply to all purchases made through the WEBSITE while it remains available online.

The SELLER reserves the right to amend or update these Terms & Conditions at any time.

The applicable version shall be the version in force on the date the CUSTOMER places an order.

Any amendments shall not affect orders already confirmed before the changes take effect.

19. GOVERNING LAW AND JURISDICTION

These Terms & Conditions shall be governed by and construed in accordance with French law.

Nothing in these Terms & Conditions shall deprive consumers of any mandatory legal rights granted under the laws of their country of residence where such rights are applicable.

In the event of a dispute, the parties shall seek an amicable resolution before commencing legal proceedings.

APPENDIX 1

WITHDRAWAL POLICY

The CUSTOMER has the right to withdraw from this contract without giving any reason within fourteen (14) days.

Withdrawal Period

The withdrawal period expires fourteen (14) calendar days after the day on which the CUSTOMER, or a third party designated by the CUSTOMER other than the carrier, takes physical possession of the PRODUCT.

If the CUSTOMER has ordered multiple PRODUCTS delivered separately, the withdrawal period expires fourteen (14) calendar days after the day on which the CUSTOMER, or a third party designated by the CUSTOMER other than the carrier, takes possession of the last PRODUCT.

Exercising the Right of Withdrawal

To exercise the right of withdrawal, the CUSTOMER must notify the SELLER of their decision by means of an unequivocal statement sent to:

Model Withdrawal Form

The CUSTOMER may use the model withdrawal form available on the WEBSITE at www.luberone.com.

If this option is used, the SELLER will promptly acknowledge receipt of the withdrawal request on a durable medium.

To meet the withdrawal deadline, the CUSTOMER must send the withdrawal notice before the withdrawal period expires.

Effects of Withdrawal

If the CUSTOMER withdraws from this contract, the SELLER shall reimburse all payments received from the CUSTOMER, including standard delivery costs (excluding any additional costs resulting from the CUSTOMER choosing a delivery method other than the least expensive standard delivery option offered by the SELLER).

Such reimbursement shall be made without undue delay and no later than fourteen (14) days from the date on which the SELLER is informed of the CUSTOMER'S decision to withdraw.

The reimbursement will be made using the same payment method used for the original transaction unless expressly agreed otherwise by the CUSTOMER.

No fees will be charged to the CUSTOMER in connection with the reimbursement.

The SELLER may withhold reimbursement until the returned PRODUCT has been received or until proof of return shipment has been provided, whichever occurs first.

Returning the Product

The CUSTOMER must return the PRODUCT without undue delay and no later than fourteen (14) days after notifying the SELLER of the decision to withdraw.

The deadline is deemed met if the PRODUCT is shipped before the fourteen-day period expires.

Return Shipping Costs

The CUSTOMER is responsible for the direct cost of returning the PRODUCT.

For orders shipped outside the European Union (including Switzerland, Norway, the United Kingdom, the United States, Canada, Australia and other non-EU countries), return shipping costs, customs duties, import taxes, customs clearance charges and any other administrative fees incurred during the return process shall remain entirely the responsibility of the CUSTOMER.

Size exchanges are not available for orders shipped outside the European Union.

For orders shipped outside the European Union, customs duties, import taxes, customs clearance charges and any administrative fees paid by the CUSTOMER or by local authorities are non-refundable.

Condition of Returned Products

The CUSTOMER shall only be liable for any diminished value of the PRODUCT resulting from handling beyond what is necessary to establish its nature, characteristics and proper functioning.

APPENDIX 2

DELIVERY POLICY

Delivery Area

PRODUCTS may only be delivered within the TERRITORY.

Orders cannot be placed for delivery addresses located outside the TERRITORY.

PRODUCTS will be shipped to the delivery address provided by the CUSTOMER during the ordering process.

Order Processing Time

Orders placed on the WEBSITE are processed Monday through Friday, excluding public holidays.

Preparation times for orders and invoicing prior to shipment are indicated on the WEBSITE.

An automatic email notification will be sent when the PRODUCTS are dispatched, provided that the email address supplied by the CUSTOMER is valid.

Delivery Times & Shipping Costs

During checkout, the SELLER informs the CUSTOMER of the available delivery methods and estimated delivery times applicable to the selected PRODUCTS.

Shipping costs are calculated according to the chosen delivery method and destination.

These costs are payable in addition to the purchase price of the PRODUCTS.

Detailed information regarding delivery times and shipping charges is available on the WEBSITE.

Delivery Conditions

Delivery procedures depend on the selected carrier and the destination country.

Depending on the shipping method chosen, delivery may require a signature upon receipt.

If the CUSTOMER is absent at the time of delivery, a delivery notice may be left allowing collection of the parcel from the designated collection point.

Delivery Issues

The CUSTOMER is informed of the estimated delivery date during the ordering process before confirming the order.

If the SELLER fails to deliver within the agreed timeframe, the CUSTOMER may request delivery within an additional reasonable period appropriate to the circumstances.

In any event, the SELLER undertakes to deliver the PRODUCTS within thirty (30) calendar days following conclusion of the contract.

If delivery is not completed within the additional period granted by the CUSTOMER, or within thirty (30) calendar days of the contract being concluded, the CUSTOMER may terminate the contract.

The SELLER shall reimburse all sums paid, including applicable delivery charges, without undue delay and using the same payment method used by the CUSTOMER for the original transaction.
